By downloading, accessing, or using Day Agenda, you agree to be bound by these Terms & Conditions and all applicable laws and regulations.
If you do not agree to these terms, you should discontinue use of the app.
2. Eligibility
You must be at least 13 years old to use Day Agenda.
If you are under the age required by your local laws to consent to digital services, you may only use the app with permission from a parent or legal guardian.
3. App Features and Services
Day Agenda provides productivity, scheduling, weather, mindfulness, health, focus, and organizational tools designed to help users manage their day.
Features may include:
- Calendar and reminder management
- Weather and location-aware experiences
- Focus timers and meditation tools
- Health and wellness integrations
- Sleep and activity summaries
- Flight and travel-related information
- Intelligent summaries
- AI-powered planning and scheduling assistance
- Home Screen widgets, Lock Screen widgets, Control Center actions, and Live Activities for next-up events
- Quotes, historical context, and ambient experiences
Features may evolve, change, or be removed over time. Certain features may depend on device support, operating system version, permissions, network availability, or third-party service availability.
4. Health and Wellness Disclaimer
Day Agenda may display health, wellness, mindfulness, sleep, hydration, fitness, or activity-related information through integrations such as Apple HealthKit.
This information is provided for informational and lifestyle purposes only and is not intended as medical advice, diagnosis, or treatment.
You should consult qualified healthcare professionals regarding medical concerns or decisions.
5. AI and Intelligent Summary Features
Day Agenda may provide intelligent summaries, planning suggestions, scheduling recommendations, and contextual guidance using different provider options.
Available providers may include:
- Day Agenda: built-in local logic and optional cloud-assisted processing operated by Day Agenda for planning, recommendations, scheduling assistance, and contextual productivity features.
- Apple Intelligence: on-device Apple Foundation Models, when available on supported devices and operating systems.
- ChatGPT: an optional OpenAI-powered summary provider available when users choose to connect their own OpenAI API key.
- Gemini: an optional Google-powered summary provider available when users choose to connect their own Google API key.
- Claude: an optional Anthropic-powered summary provider available when users choose to connect their own Anthropic API key.
Use of ChatGPT, Gemini, or Claude summary providers is optional. Users are responsible for maintaining their own provider accounts, API keys, usage limits, billing relationships, and compliance with the selected provider’s terms and policies.
Day Agenda planning features use Day Agenda’s own provider infrastructure and do not use your third-party API keys.
AI-generated or model-assisted content may be inaccurate, incomplete, delayed, or unsuitable for your specific circumstances.
You are responsible for reviewing and validating summaries, plans, recommendations, and actions before relying on them.
Day Agenda does not guarantee the availability, accuracy, performance, or continued operation of third-party AI providers, including OpenAI, Google Gemini, or Anthropic Claude services.
6. Widgets, Control Center, and Live Activities
Day Agenda may offer Home Screen widgets, Lock Screen widgets, Control Center actions, and Live Activities to make selected app information and actions available outside the main app. Live Activities are limited to next-up event information and are not designed to show events already in progress.
These features may display time-sensitive or personal information from your calendar, reminders, timers, health summaries, weather, daily context, or next-up event on device surfaces that could be visible to others near your device.
You are responsible for choosing which widgets, controls, and Live Activities to enable and for managing related settings through iOS.
7. Subscriptions and Payments
Certain features of Day Agenda may require a paid subscription.
Subscription purchases and billing are handled through Apple’s App Store infrastructure and are governed by Apple’s payment terms and policies.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Pricing, subscription tiers, and available features may change at any time.
Day Agenda subscriptions do not include, resell, or manage OpenAI, Google Gemini, or Anthropic Claude usage, credits, or billing. Any use of an optional third-party summary provider is governed by the user’s own provider account and API usage.
8. Acceptable Use
You agree not to:
- Use the app for unlawful purposes
- Attempt to reverse engineer the app
- Interfere with app security or stability
- Exploit bugs or vulnerabilities
- Use automated systems to abuse app functionality
- Transmit malicious software or harmful code
- Misuse AI-powered features
- Use third-party API keys you do not own or have permission to use
We reserve the right to suspend or terminate access for behavior that violates these terms or harms the app, platform, or other users.
9. Intellectual Property
All app content, visuals, branding, designs, software, animations, interfaces, graphics, logos, and related materials are owned by Day Agenda or its licensors and are protected under intellectual property laws.
You may not:
- Copy or redistribute app assets
- Modify or create derivative works
- Reverse engineer source code
- Resell or sublicense app content
- Use branding without written permission
10. Third-Party Services
Day Agenda may rely on Apple frameworks and third-party services to provide functionality.
This may include:
- Apple EventKit
- Apple HealthKit
- Apple WeatherKit
- Apple Maps
- Apple Foundation Models / Apple Intelligence
- OpenAI APIs, when users voluntarily connect their own OpenAI API key for optional ChatGPT-powered summaries
- Google Gemini APIs, when users voluntarily connect their own Google API key for optional Gemini-powered summaries
- Anthropic APIs, when users voluntarily connect their own Anthropic API key for optional Claude-powered summaries
- FlightAware
- NOAA Tides and Currents
- ZenQuotes
- Wikipedia
These services are governed by their own privacy policies and terms. We are not responsible for outages, inaccuracies, delays, billing issues, rate limits, or changes introduced by third-party services.
11. Availability and Modifications
We may modify, suspend, discontinue, or update app features at any time without prior notice.
We do not guarantee uninterrupted availability, compatibility, or error-free operation.
12. Disclaimer of Warranties
Day Agenda is provided “as is” and “as available” without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, we disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, reliability, and accuracy.
13. Limitation of Liability
To the fullest extent permitted by law, Day Agenda and its affiliates shall not be liable for indirect, incidental, consequential, or special damages arising from your use of the app.
This includes, but is not limited to:
- Missed events or reminders
- Scheduling conflicts
- Loss of productivity
- Data loss
- Health or wellness outcomes
- Service interruptions
- Third-party provider outages or rate limits
- Third-party API billing, usage, or account issues
- AI-generated inaccuracies
Your use of the app is at your own risk.
14. Termination
We may suspend or terminate access to Day Agenda if you violate these Terms & Conditions or misuse the platform.
You may stop using the app and delete it from your device at any time.
15. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
16. Apple App Store Terms
If you downloaded Day Agenda through the Apple App Store, you acknowledge that:
- Apple is not responsible for the app or its content
- Apple has no obligation to provide support or maintenance
- Apple is a third-party beneficiary of these terms
Your use of the app must comply with applicable App Store terms and policies.
17. Changes to These Terms
We may update these Terms & Conditions periodically to reflect app updates, legal requirements, or platform changes.
Continued use of the app after updates constitutes acceptance of the revised terms.
