Day Agenda is built to help organize your day, improve focus, and provide contextual productivity and wellness features. By using the app, you agree to these Terms & Conditions.

1. Acceptance of Terms

By downloading, accessing, or using Day Agenda, you agree to be bound by these Terms & Conditions and all applicable laws and regulations.

If you do not agree to these terms, you should discontinue use of the app.

2. Eligibility

You must be at least 13 years old to use Day Agenda.

If you are under the age required by your local laws to consent to digital services, you may only use the app with permission from a parent or legal guardian.

3. App Features and Services

Day Agenda provides productivity, scheduling, weather, mindfulness, health, focus, and organizational tools designed to help users manage their day.

Features may include:

  • Calendar and reminder management
  • Custom Daily Digest sections, including maps, news, readings, intentions, and reflections
  • Weather and location-aware experiences
  • Basic, Mindfulness, Focus, and silent Sleep timers
  • Apple Music and ambient audio, with synced music pins
  • Sleep schedules, wind-down, and optional wake alarms
  • Visual countdowns, Smart Highlights, and wellness goals
  • Siri and Shortcuts actions on supported devices
  • Health and wellness integrations
  • Sleep and activity summaries
  • Flight and travel-related information
  • Intelligent summaries
  • AI-powered planning from prompts, photos, and supported files
  • iPhone, Apple Watch, iPad, and Mac Catalyst experiences
  • Home Screen widgets, Lock Screen widgets, Control Center actions, and supported event, flight, and timer Live Activities
  • iCloud sync for selected app settings, records, and companion context
  • Quotes, historical context, reading content, and ambient experiences

Features may evolve, change, or be removed over time. Certain features may depend on device support, operating system version, permissions, network availability, or third-party service availability.

Flight features use AeroDataBox as the primary flight-data provider and may use FlightAware to supplement missing gate, terminal, or baggage-claim information. Day Agenda may maintain one shared flight record for a flight occurrence and use Apple Push Notification service to deliver flight notifications and remote Live Activity updates to subscribed installations. A final flight record is scheduled for deletion seven days after its final state; if no final state arrives, it expires seven days after the scheduled arrival.

Flight information is provided for convenience and may be incomplete, delayed, unavailable, or inconsistent with airline or airport systems. Always verify departure times, arrival times, status, gates, terminals, baggage claims, and travel instructions directly with the airline or airport before making travel decisions.

Day Agenda may be available on iPhone, Apple Watch, iPad, and Mac through Mac Catalyst. Platform-specific features, permissions, and data sources may differ between iOS, watchOS, iPadOS, and macOS. The Mac experience may rely on a limited app-generated iCloud snapshot from your Apple account to display selected schedule, reminder, health-summary, preference, and day-context information. This snapshot may be delayed, incomplete, or unavailable depending on iCloud status, network availability, device permissions, and platform behavior.

4. Health and Wellness Disclaimer

Sleep timers are audio-stop tools, not wake alarms. They finish without alert sounds, haptics, or completion notifications. Sleep schedules and optional wake alarms are separate. Timers, urgent reminder alarms, and wake alarms depend on supported devices, permissions, and system behavior. Companion sync and Health logging may be delayed; they are not emergency services.

Day Agenda may display health, wellness, mindfulness, sleep, hydration, fitness, or activity-related information through integrations such as Apple HealthKit.

5. AI and Intelligent Summary Features

Day Agenda may provide intelligent summaries, planning suggestions, scheduling recommendations, and contextual guidance using different provider options.

Available providers may include:

  • Day Agenda: built-in local logic and optional cloud-assisted processing operated by Day Agenda for planning, recommendations, scheduling assistance, and contextual productivity features.
  • Apple Intelligence: on-device Apple Foundation Models, when available on supported devices and operating systems.
  • ChatGPT: an optional OpenAI-powered summary provider available when users choose to connect their own OpenAI API key.
  • Gemini: an optional Google-powered summary provider available when users choose to connect their own Google API key.
  • Claude: an optional Anthropic-powered summary provider available when users choose to connect their own Anthropic API key.

Use of ChatGPT, Gemini, or Claude summary providers is optional. Users are responsible for maintaining their own provider accounts, API keys, usage limits, billing relationships, and compliance with the selected provider’s terms and policies.

Day Agenda planning features use Day Agenda’s own provider infrastructure and do not use your third-party API keys. Usage limits apply. Imported photos and documents are processed into text for the planning request. Only submit content you have the right to use and share, and review dates, times, and generated drafts before adding them to your calendars or reminders.

Daily Digest content may include map routes, news or feed items, quotes, historical context, word or reading content, horoscope settings, intentions, and reflection prompts. You are responsible for choosing the sections and sources you enable, reviewing content before relying on it, and only entering intentions or reflections you are comfortable storing or syncing through the app.

AI-generated or model-assisted content may be inaccurate, incomplete, delayed, or unsuitable for your specific circumstances.

You are responsible for reviewing and validating summaries, plans, recommendations, and actions before relying on them.

Day Agenda does not guarantee the availability, accuracy, performance, or continued operation of third-party AI providers, including OpenAI, Google Gemini, or Anthropic Claude services.

6. Widgets, Control Center, and Live Activities

Day Agenda may offer Home Screen widgets, Lock Screen widgets, Control Center actions, and Live Activities to make selected app information and actions available outside the main app. Live Activities support selected event, flight, and timer information, depending on device and feature availability.

These features may display time-sensitive or personal information from your calendar, reminders, timers, health summaries, weather, daily context, or next-up event on device surfaces that could be visible to others near your device.

You are responsible for choosing which widgets, controls, and Live Activities to enable and for managing related settings through Apple platform settings.

Remote flight notifications and Live Activity updates depend on third-party flight data, Day Agenda service infrastructure, network connectivity, and Apple Push Notification service. Updates may arrive late, be incomplete, or not arrive, and the operating system controls how long and where a Live Activity is displayed.

7. Subscriptions and Payments

Apple Music playback requires the appropriate Apple Music subscription and authorization. It is separate from Day Agenda Pro. Catalog availability, recommendations, and playback depend on Apple, your account, region, and connectivity. Music remains licensed by its rights holders; using Day Agenda does not grant redistribution rights. Pinned music syncs references, not audio downloads or playback handoff.

Certain features of Day Agenda may require a paid subscription.

Subscription purchases and billing are handled through Apple’s App Store infrastructure and are governed by Apple’s payment terms and policies.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

Pricing, subscription tiers, and available features may change at any time.

Day Agenda subscriptions do not include, resell, or manage OpenAI, Google Gemini, or Anthropic Claude usage, credits, or billing. Any use of an optional third-party summary provider is governed by the user’s own provider account and API usage.

8. Acceptable Use

You agree not to:

  • Use the app for unlawful purposes
  • Attempt to reverse engineer the app
  • Interfere with app security or stability
  • Exploit bugs or vulnerabilities
  • Use automated systems to abuse app functionality
  • Transmit malicious software or harmful code
  • Misuse AI-powered features
  • Use third-party API keys you do not own or have permission to use

We reserve the right to suspend or terminate access for behavior that violates these terms or harms the app, platform, or other users.

9. Intellectual Property

All app content, visuals, branding, designs, software, animations, interfaces, graphics, logos, and related materials are owned by Day Agenda or its licensors and are protected under intellectual property laws.

You may not:

  • Copy or redistribute app assets
  • Modify or create derivative works
  • Reverse engineer source code
  • Resell or sublicense app content
  • Use branding without written permission

10. Third-Party Services

Day Agenda may rely on Apple frameworks and third-party services to provide functionality.

This may include:

  • Apple EventKit
  • Apple HealthKit
  • Apple WeatherKit
  • Apple Maps
  • Apple Music / MusicKit
  • Apple Push Notification service for notifications and remote flight Live Activity updates
  • Unsplash API for optional countdown imagery
  • Apple iCloud / CloudKit and key-value storage for app sync and companion snapshots
  • Apple Foundation Models / Apple Intelligence
  • OpenAI APIs, when users voluntarily connect their own OpenAI API key for optional ChatGPT-powered summaries
  • Google Gemini APIs, when users voluntarily connect their own Google API key for optional Gemini-powered summaries
  • Anthropic APIs, when users voluntarily connect their own Anthropic API key for optional Claude-powered summaries
  • AeroDataBox for primary flight schedules, status, milestones, routes, positions, airport operations, and update webhooks
  • FlightAware to supplement missing gate, terminal, and baggage-claim information for supported flights
  • Upstash Redis for temporary shared flight records and push subscription data
  • NOAA Tides and Currents
  • ZenQuotes
  • Wikipedia
  • Selected news, reading, horoscope, or other content sources for optional Digest sections

These services are governed by their own privacy policies and terms. We are not responsible for outages, inaccuracies, delays, billing issues, rate limits, or changes introduced by third-party services.

11. Availability and Modifications

We may modify, suspend, discontinue, or update app features at any time without prior notice.

We do not guarantee uninterrupted availability, compatibility, or error-free operation.

12. Disclaimer of Warranties

Day Agenda is provided “as is” and “as available” without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, we disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, reliability, and accuracy.

13. Limitation of Liability

To the fullest extent permitted by law, Day Agenda and its affiliates shall not be liable for indirect, incidental, consequential, or special damages arising from your use of the app.

This includes, but is not limited to:

  • Missed events or reminders
  • Scheduling conflicts
  • Loss of productivity
  • Data loss
  • Health or wellness outcomes
  • Service interruptions
  • iCloud sync delays, conflicts, or unavailable snapshots
  • Third-party provider outages or rate limits
  • Third-party API billing, usage, or account issues
  • AI-generated inaccuracies
  • Incorrect, delayed, incomplete, or missing flight status, gate, terminal, baggage, notification, or Live Activity information

Your use of the app is at your own risk.

14. Termination

We may suspend or terminate access to Day Agenda if you violate these Terms & Conditions or misuse the platform.

You may stop using the app and delete it from your device at any time.

15. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

16. Apple App Store Terms

If you downloaded Day Agenda through the Apple App Store, you acknowledge that:

  • Apple is not responsible for the app or its content
  • Apple has no obligation to provide support or maintenance
  • Apple is a third-party beneficiary of these terms

Your use of the app must comply with applicable App Store terms and policies.

17. Changes to These Terms

We may update these Terms & Conditions periodically to reflect app updates, legal requirements, or platform changes.

Continued use of the app after updates constitutes acceptance of the revised terms.
